The United States Consulate or Embassy in the applicant’s home country has sole jurisdiction in approving or denying non-immigrant visa petitions. One of the main reasons that non-immigrant visas are denied is because in the opinion of the interviewing officer, the applicant was unable to demonstrate significant enough ties to his or her homeland which would evidence an intent to return to his or her home country after their stay in the United States. Denials based on this reason are not subject to appeal or reconsideration.
